The police disclosed the driver's blood alcohol level at the time of Johnny and Matthew Gaudreau's accident

Sean M. Higgins, the driver charged in the tragic deaths of NHL player Johnny Gaudreau and his brother Matthew, had a blood alcohol content of .087, above New Jersey's legal limit of .08, prosecutors disclosed on Friday.

The Gaudreau brothers, aged 31 and 29, were cycling in Carneys Point, New Jersey, on August 29, the night before they were to be groomsmen at their sister Katie's wedding.

Higgins, 43, from Woodstown, New Jersey, faces charges including death by auto, reckless driving, and possession of an open container. At a virtual court hearing, a judge decided Higgins would be held for trial despite his defence arguing his character and previous good behaviour. Higgins admitted to drinking five or six beers and consuming alcohol while driving. He failed a field sobriety test and reportedly became frustrated with other drivers, speeding around them and striking the Gaudreau.

Johnny Gaudreau, known as "Johnny Hockey," had a notable NHL career with the Columbus Blue Jackets and previously with the Calgary Flames. His widows, Meredith and Madeline, both expecting, gave emotional eulogies at the joint funeral, celebrating the brothers' close relationship. If convicted, Higgins faces a potential 20-year prison sentence.
